Getting People Home

Mass incarceration in the United States is a major driver of family devastation, community decimation, and increased inequality. The sheer number of incarcerated Americans is staggering. Beyond the enormity of those numbers, we also understand that behind each prison sentence imposed on a criminal defendant is a loving family torn by the pains of family separation. Not only are the innocent sometimes wrongly incarcerated in the United States, individuals who have committed crimes are also treated too harshly and too cruelly by the American legal system. Too often, criminal defendants are sentenced in proceedings that focus only on the criminal conduct at question that fail to consider the individual circumstances of the criminal defendant that might be important when deciding the most just sentence to impose.

There are a number of avenues available in State and Federal court to seek an earlier release of those who have been convicted and are currently serving prison sentences. At Koch Garg & Brown, LLP, we take particular joy in getting people home with their loved ones as soon as possible, and we have had tremendous success in helping individuals earn their early release. Some of the available avenues for early release from sentence are:

  • Sentence modification
  • Compassionate release
  • Sentence reduction under the First Step Act
  • Motion to Correct Illegal Sentence
  • Commutation
  • Habeas Corpus
  • Juvenile Parole Hearings under Public Act 15-84
  • Special Parole Hearings
  • Discretionary Parole Hearings
  • Exoneration via petition for new trial and/or habeas corpus
